GENERAL CONDITIONS OF USE

I — On the General Terms of Use

I.1 - Scope

“User Account”: refers to the User's personal account on the Site.
“Parties”: refers to Pet Alert and Users.
“Service”: refers to any service provided by means of the Site to a User.
“Site”: refers to the site http://www.petalertfrance.com/ and more generally any website or mobile application containing, with the authorization of Pet Alert, the information published on the preceding site and offering similar services.
“User” or “you”: refers to the natural person who has accepted these General Terms of Use and who uses the Site.

I.3 - Online acceptance of the General Terms of Use

The use of the Site and the Service is subject to the acceptance of these Terms of Use, which are systematically accessible on the Site. These CGU determine the rights and obligations of Pet Alert and Users (together the “Parties” or individually a “Party”) to the various contracts offered on the Site. II.2 - Delivery of the Service

L’Utilisateur reconnaît et accepte que, dans certains cas exceptionnels, le délai de diffusion puisse être légèrement allongé, notamment en raison d’événements indépendants de la volonté de Pet Alert (panne de service Facebook, volume d’activité exceptionnel, cas de force majeure, etc.).

II.3 - Service Rates and Payment

Les professionnels souhaitant utiliser notre réseau pour publier des annonces ne peuvent pas bénéficier de la gratuité destinée aux particuliers. Ils doivent contacter notre support pour obtenir un accès professionnel. Des conditions spécifiques et des frais supplémentaires peuvent s’appliquer. Tout professionnel utilisant le service gratuit sans autorisation sera susceptible de faire l’objet de mesures restrictives de la part de Pet Alert.

Options Payantes
Des fonctionnalités ou services complémentaires peuvent être proposés sous forme d’options payantes. Les tarifs et détails de ces options sont clairement affichés sur le Site.
En souscrivant à l’une de ces options, l’Utilisateur accepte sans réserve les présentes Conditions Générales de Vente et d’Utilisation, après en avoir pris connaissance et compris la portée.

Modification des Tarifs
Pet Alert se réserve le droit de modifier ses tarifs à tout moment. Ces modifications s’appliqueront uniquement aux commandes futures et n’auront aucun effet rétroactif sur les services déjà réglés.

Confirmation de Paiement
Lorsqu’un Utilisateur règle une option payante, un e-mail de confirmation de paiement lui est envoyé une fois la commande validée.

II.4 - Obligations and responsibilities of the User

II.5 — Obligations and responsibilities of Pet Alert

II.7 — Boosts usage clause on Pet Alert

Boosts are paid features offered by Pet Alert that offer users the opportunity to benefit from an accelerated and localized distribution of their ads concerning lost animals. These Boosts allow greater visibility through the use of advertising on Facebook (FB Ads). Pet Alert offers three types of Boosts with specific sharing guarantees:diffusion prioritaire, localisée et accélérée des annonces relatives aux animaux perdus. Cette diffusion optimisée repose principalement sur la publicité ciblée sur Facebook (FB Ads).

Types de Boosts et engagements associés :
Boost Eco (30 €) : garantit en moyenne 50 partages dans les 48 heures suivant la mise en ligne.
Boost Optimal (50 €) : garantit en moyenne 150 partages dans un délai de 72 heures.
Boost Maximal (100 €) : garantit en moyenne 400 partages dans un délai de 5 jours.

Garantie de partage et conditions de “reboost” :
Si, à l’expiration du délai garanti, le nombre de partages prévu n’est pas atteint, l’Utilisateur peut demander un reboost gratuit en envoyant un email à l’adresse support(at)petalertfrance.com. Cette demande est soumise aux conditions suivantes :
- L’animal n’a pas encore été déclaré “retrouvé” dans la base de données Pet Alert.
- La demande de reboost est envoyée dans un délai de 24 heures après l’expiration du délai de garantie.
- Un seul reboost est possible par annonce.

Autres précisions :
- Aucun remboursement n’est possible une fois le Boost lancé, y compris si l’animal est retrouvé peu après la mise en ligne de l’annonce.
- Pet Alert ne peut garantir une date précise de publication publicitaire ni la durée exacte de visibilité, car cela dépend également des algorithmes et mécanismes propres à Facebook.
En utilisant les Boosts, l’Utilisateur reconnaît avoir pris connaissance des présentes conditions, les avoir comprises et les accepter sans réserve.

III - General

III.1 - Access to the Site

Pet Alert strives to ensure the availability of the Site and the Service 24 hours a day, 7 days a week. However, access to the Site or the Service may be interrupted as part of maintenance operations, hardware or software upgrades, emergency site repairs, or as a result of circumstances beyond the control of Pet Alert (such as, for example, failure of telecommunications links and equipment). III.3 - Processing of Users' personal data and site content

Information allowing the User to identify himself, such as the username and password, is personal and confidential. This information may only be modified at the initiative of the User or Pet Alert, in particular in the event that the password is forgotten. The User is solely responsible for the use of his identification elements; he is required to keep them secret. Any disclosure on his part can in no way be blamed on Pet Alert. Any order made using the User's username and password is deemed to have been placed by the User. Under no circumstances can Pet Alert be held responsible for damage caused by the disclosure of this personal and confidential data by the User and therefore for the use of this data by a third party. In any event, Pet Alert cannot be held responsible for any damage of any nature whatsoever, in particular as a result of the use of the subscribed services, damage to reputation, image, or loss of data that may occur as a result of the use of the services offered by Pet Alert.

III.3.f - Hosting of the site

The host of the site mentioned in article I.1 of these T&Cs acts as a subcontractor of Pet Alert, within the meaning of the “Informatique et Libertés” law, only on written instructions from Pet Alert, and does not have the right to use the personal data of users to which he is likely to have access, except for the purposes of performing technical services for hosting and managing databases and only under the contractual conditions signed between the host and Pet Alert who cannot derogate from this article.

III.4 - Intellectual property

The site https://www.petalertfrance.com/ is the property of Pet Alert. All elements of the Site, whether visual or audio, texts, layouts, layouts, illustrations, photographs, documents and other elements, including the underlying technology, are protected by copyright, trademark and patent rights. III.6 - Partner sites

By accepting these T&Cs, you agree that the information provided at the time of registration will be published on the Pet Alert site. Pet Alert reserves the right to reproduce any information appearing on the Site or on partner sites. In particular, ads published on one of the sites published or co-edited by Pet Alert may be reproduced on other sites published or co-published by Pet Alert or third parties.

III.7 - General payment terms for all Site Services

Pet Alert prices are in euros and include all taxes included.Payment for the Services will be made by bank card (Blue, Visa, Mastercard). Payments made will be secured by a data encryption procedure in order to avoid the interception of this information by a third party. Payments made by the User are considered final after effective collection of the amounts.PET Alert cannot be held responsible in the event of fraudulent use of the means of payment used on the Site or in the event of an error due to the payment system.

III.8 - Newsletter subscription

By accepting these Terms of Use, the User authorizes Pet Alert to send him emails to the address he provided when registering, subscribing or ordering. Unsubscribing to the newsletter is possible at any time via the “My Account” area.

III.9 - Safeguard clause

If one or more stipulations of these T&Cs were declared invalid pursuant to a law or regulation or a final court decision, the other stipulations would remain in force and effect.

III.10 - Transfer of rights and obligations

In the event of total or partial transfer of the activity of Pet Alert, the contracts between the User and Pet Alert and/or successors and assigns remain binding between the Parties. Contracts entered into by Pet Alert cannot be transferred by the User without the prior written consent of Pet Alert. The contracts, rights and obligations of Pet Alert may in any event be assigned or transferred without the prior consent of the User.

III.11 - Force majeure

Pet Alert cannot be considered as engaging its responsibility for total or partial contractual non-performance due to a force majeure event, independent of its will.

III.12 — Convention on evidence

The User acknowledges the validity and probative value of electronic exchanges and records kept by Pet Alert and acknowledges that these elements receive the same evidentiary force as a handwritten document under Law No. 2000-230 of 13 March 2000 adapting the law of evidence to information technology and relating to electronic signatures.Users acknowledge that the communications and computerized records of the Site will be considered by the Parties as proof of exchanges, orders, payments and transactions between the Parties unless proven otherwise. In the event that Pet Alert has to communicate them, they will be considered admissible, valid and enforceable between the Parties, in the same manner, under the same conditions and with the same probative force as any document that is drawn up, received or kept in writing, unless there is a manifest error by Pet Alert.

III.13 - Disputes

Any claim against Pet Alert in connection with these T&Cs is time-barred within one year. It is irrefutably presumed that the User renounces a payment that has not been requested within one year. Unclaimed amounts are acquired by Pet Alert.

III.13 - Litiges

III.13.a - Prescription

Toute réclamation contre Pet Alert en relation avec les présentes CGU se prescrit dans un délai d'un an. Il est irréfragablement présumé que l’Utilisateur renonce à un paiement qui n'aura pas été demandé dans un délai d'un an. Les sommes non réclamées sont acquises à Pet Alert.

III.13.b - Applicable law and competent jurisdictions

IV.1 - Objet du SmartTag

Le SmartTag Pet Alert est un médaillon connecté équipé d’un QR code unique. Il permet à toute personne disposant d’un smartphone d’accéder, via un simple scan, à une fiche d’identité numérique de l’animal. Cette fiche peut contenir des informations telles que son nom, sa race, son âge, ses besoins médicaux et les coordonnées du propriétaire. Le service inclut également :
- L’envoi d’une alerte SMS et email au propriétaire dès qu’un scan est effectué ;
- L’activation automatique d’un Boost Maximal Pet Alert en cas de perte, diffusant massivement une alerte sur les réseaux sociaux et nos moteur de recherche.

IV.2 - Modalités d’achat et activation

Le SmartTag Pet Alert est vendu en paiement unique. Le prix comprend :
- Le médaillon (Smart Tag) physique avec QR code
- La création de la fiche d’identité numérique de l’animal
- Les alertes par SMS et email
- Le MAXIBoost Pet Alert
- La livraison
- L’accès à l’assistance Pet Alert
- Les frais d'activation d'un montant de 20€.
L’utilisateur doit, après achat, compléter les informations de son animal via l’espace client. L’activation du service est immédiate dès validation de la commande et saisie des données.

IV.3 - Durée, expiration et reconduction

Le service SmartTag est actif pendant la durée choisie lors de l’achat : 1 an, 3 ans ou 5 ans.
À l’expiration de cette période :
- Le QR code continue de fonctionner : une personne pourra toujours scanner le tag.
- Le propriétaire recevra une notification de scan, mais ne pourra plus accéder à la localisation ni contacter directement la personne ayant trouvé l’animal, sauf à souscrire un renouvellement.
Un forfait unique de 99 € TTC permet de consulter la localisation du scan et d'entrer en contact avec la personne ayant effectué le scan.
Une reconduction automatique est activée par défaut et peut être désactivée à tout moment via son espace client.

IV.4 - Durée, expiration et reconduction

Les SmartTags sont expédiés sous 2 à 7 jours ouvrés. Les frais de livraison sont inclus dans le prix d’achat. En cas de perte ou détérioration du Tag, un remplacement gratuit est inclus dans la limite de une fois par an et par animal. La demande se fait par l'envoie d'un simple email à tag(at)petalertglobal.com.

IV.5 - Responsabilité et bon usage

Pet Alert ne saurait être tenu responsable en cas de :
- Non-retour de l’animal après scan du Tag
- Absence de réseau ou impossibilité technique de transmission d’alerte
- Mauvaise saisie ou non-mise à jour des informations par l’utilisateur
- Usure ou détérioration volontaire du médaillon
L’utilisateur est responsable du bon usage du Tag et des données affichées.

IV.6 - Traitement des données personnelles

Les données personnelles saisies pour l’activation et l’utilisation du SmartTag (identité de l’animal, coordonnées du propriétaire, infos médicales) sont traitées conformément au Règlement Général sur la Protection des Données (RGPD). L’utilisateur peut à tout moment :
- Modifier ou supprimer les données liées au Tag.
- Masquer ses coordonnées à l’affichage public.
- Désactiver ou clôturer son Tag via l’espace client.

IV.7 - Garantie légale

Le SmartTag Pet Alert est couvert par la garantie légale contre les défauts de fabrication, conformément aux articles L.217-4 et suivants du Code de la consommation.

IV.8 - Absence de droit de rétractation

Conformément à l’article L221-28 du Code de la consommation, le droit de rétractation ne s’applique pas à la commande d’un SmartTag Pet Alert.
En validant sa commande, l’utilisateur accepte expressément que l’exécution du contrat commence immédiatement :par l’expédition du Tag physique, et par l’activation des services (fiche en ligne, alertes, espace client).
Ainsi, le droit de rétractation est expressément renoncé dès la validation de la commande.

IV.9 - Annonce prioritaire et Boost Maximal inclus

Chaque SmartTag Pet Alert donne droit, une fois par an, à :
- Une annonce prioritaire (valeur : 25 €)
- Un Boost Maximal Pet Alert (valeur : 100 €)
Selon la durée choisie, cela représente :
- Tag 1 an : 125 € de services inclus

Tag 3 ans : 375 € de services inclus

Tag 5 ans : 625 € de services inclus
Ces services sont activables via l’espace client, une fois par an, non transférables, non cumulables, et soumis à l’année civile du Tag. Toute activation supplémentaire est facturée au tarif en vigueur.

⚠️ Un délai de carence de 60 jours s’applique uniquement aux Boost Maximal et Annonce Prioritaire de Pet Alert. Pendant cette période, ces deux services ne sont pas encore accessibles. Cette mesure vise à prévenir les utilisations abusives et garantir l’intégrité de la plateforme.

Toutes les autres fonctionnalités du SmartTag sont actives immédiatement après la commande : scan du QR code, accès à la fiche d’identité, alertes SMS et email, espace client, etc.
